Pool Hustler’s Terms and Conditions

General – Acceptance of the T & C’s
This Mobile Application (“App”/ “Platform”) is operated by POOL HUSTLERS LTD (“We/Us”). We are registered in England and Wales under company number, 13252491 and have our registered office at 6 Beecher Court, Lanadron Close, Isleworth, United Kingdom, TW7 5GD.
Please read all the Terms and Conditions (hereinafter “T&C’s”) hereinafter carefully before using the Platform operated by Us. This will take you about around 20 minutes or so.
These T&C’s for the Platform is a binding legal contract between the Participant (“You”/ “User”) and Us. These T&C’s governs the relationship between you and Pool Hustlers.
By registering, downloading, installing, accessing or using the Platform, you acknowledge that you understand the implications of the T&C’s and agree to be bound by them.
As the T&C’s may affect your legal rights and obligations, kindly only proceed to the next stage of registration if you agree to be bound by this Agreement and if you meet the criteria.
Pool Hustlers Account
You need to create a Pool Hustlers Account in order to be able to freely access the Platform and play the game.
To create this Account, you will need to provide us the following information
a valid email address
or phone number
First name and last name / User name
This Platform is intended for Users who are at least 18 years old and has been designed accordingly. All the Participants must be over the age of 18 before participating in the games for monetary prizes. By creating an account with Us, you warrant that you are 18 years old or older.
We reserve the right to request any of the Participants Users to verify their age through the Platform as we deem fit.
Tournament Structure
When Users select to be given an opportunity to compete with other players for prizes that have monetary value. The games within this Option will be highlighted in green within the Pool Tournaments (“Tournaments”).
Users can deposit money into their account which are then converted into in-game Tokens (“Tokens”) for the game usage (please refer to clause 4 for more details on this). These Tokens are the currency of the game.
These The Tokens are used to play different Pool Tournaments on the Platform.
The Users may choose to play in any of the Pool Tournaments modes available and each mode has a different participating fee which will be deducted from the Tokens in the User’s Account if they choose to play the Tournament.
Each of the Tournaments have players / Users competing against each other in that chosen Tournament mode.
Users will need to use their judgment and skills to compete against each other in this 8 ball pool game in order to move to the next rounds.
Winnings
The round will be the final round between the 2 participants / Users in the Tournament.
The winner of the last round will be deemed the winner of that Tournament and will receive their prize money which will be a % of the total participating fees collected from the players initially.
The User that retains the 2nd place will lose the total participating fees collected from all the players initially.
The remaining % of the participating fees will be retained by Us as a Management Fee.
The pool rules that apply will be used in determining the rules of the game and in identifying who is the winner.
Purchasing & Withdrawing of Tokens
Users who choose to play the cash / monetary Tournaments, will need to purchase Tokens on our Platform through our third party payment gateway / www.skillz.com
Each one Token will be equivalent to the monetary value of your currency. Users can accordingly deposit the amount they deem fit in their Accounts by purchasing Tokens as they deem fit.
Users acknowledge and agree that the payment gateway is provided solely by the relevant third party / www.skillz.com and under no circumstances will We be responsible or liable for any damages, losses or technical problems resulting due to the payment gateway’s services. Users need to contest any disputes relating to the payment directly with the payment gateway service provider and not Us.
The Users may withdraw the Tokens in their account and redeem them for cash, they are withdrawn by the Users through the same payment gateway.
Code of Conduct
As a condition for the use of the application, You have to agree to always adhere to the Code of Conduct.
The Users participating in the Tournament must always conduct themselves in a professional and respectful manner.
We hope to facilitate players from all over the world and we wish to ensure everyone has a pleasant experience. Therefore all Users must communicate positively and avoid any offensive behaviour towards any other Users during the Tournaments.
We aim to create a positive environment where Participants can come together to play games of pool and use their skills tactfully. If any Participant causes any disruption to this environment or indulges in any such conduct mentioned within this clause (below), We retain the right to ban the relevant User will be banned from the game.
1. Abuse, harass, threaten, impersonate or intimidate any other participant of the game.
2. Post any content that is inappropriate/disrespectful to any of the other participants.
3. Indulge in any kind of hateful speech and comments that may be harmful for other players and disrupt the game environment.
4. Promote any external products or services, solicit any other Participants to buy or sell any products or services on the Platform.
We will not be awarding any cues or unfavourable advantages to any of the players/Users. We will be conducting the game in a fair manner and We expect the Users to be committed to maintaining the integrity of the game at all times.
We will not accept any kind of cheating and dishonesty in the game. We will disqualify any Users that indulge in any such behaviour.
Right of Removal
If, at any given time, we feel any participants are causing a disruption to the positive and healthy gaming environment on the Platform or are not complying with any of the T&C’s and the Code of Conduct mentioned hereinafter we reserve the unconditional right to remove the participant User from the game and forbid them from participating on the platform in the future.
Intellectual Property Rights
All the content, copyright, trademarks, patents and other intellectual property materials including but not limited to, the software, artwork, design, information, gameplay, music (registered and unregistered) within the Platform belong to Pool Hustlers LTD (Us). They are protected under English Law and We retain ownership of all the proprietary content within the platform. You may only use the Platform within the guidelines in the T&C’s and nothing in these T&C’s will function to grant or transfer any ownership rights to you or any other third party.
Amendments
We reserve the right to modify these T&C’s at our sole discretion as and when necessary based on our business needs. Any such modification will be notified to all the participants Users through the Platform. Your continued use of the Platform following such modification will be deemed to mean acceptance of these modified terms.
Disclaimer of Warranties; Limitation of liability
If we breach the T&C’s or you seek compensation and damages for any claims arising in relation to the T&C’s or the Platform, the User’s remedies will be limited to damages. Our liability to you shall not exceed the amount you paid to us for the Platform through the Participating Fee except where required by law.
Except for the limited warranty provided in Section 9.1, You acknowledge that that the usage of the Platform is based on your sole discretion and risk. The Platform is provided “as is” with all faults and we do not provide performance assurances or guarantees of any kind.
To the maximum extent permissible by English law, We disclaim all warranties and conditions of any kind, express or implied. The entire risk arising out of the use of performance of the Platform remains with the Users.
It is highly probable that You may lose money whilst playing any games on our Platform. By playing our games, You acknowledge the risks of financial loss involved.
We recommend all Users to limit the amount of Tokens that they may want to purchase to the amount of money they are willing to lose whilst playing on our Platform.
We cannot control how other Users conduct themselves on the Platform. Hence, We are not responsible for any of the User’s actions and cannot be held liable for any damages arising out of the actions of other players.

Jurisdiction/ Governing Law
Any disputes or claim (including non-contractual disputes or claims) arising out of or in connection with it these Terms & Conditions, the usage of the application and the underlying system, shall be governed by and construed in accordance with the law of England and Wales.
It is agreed that the courts of England and Wales shall have the exclusive jurisdiction to settle any such disputes or claims that may arise.

Comment on the Terms & Conditions

These T&C’s have been put together looking at the relevant legislation and various samples of specific clauses via LexisNexis and Practical law. Further on, I have perused the Terms & Conditions of other tournaments that are designed similarly before drafting these T&C’s too. There can be addition of more terms if you feel that you would like certain rules or aspects of the game should be included within it. With regard to the terms relating to the Code of Conduct, I have made an assumption that there may be a way for the participants to communicate within the App during the Tournaments. Therefore, there are guidelines for the User’s behaviour. However, if there is no such feature within the App and you believe these Terms are not required, I can remove them. Please let me know any feedback and comments you have and I will be happy to amend the T&C on the basis of the same.
